FHWA rescinds the Patented and Proprietary Products rule
On October 27th, the Federal Highway Administration rescinded Patented and Proprietary Products rule (23 CFR 635.11). This clears the way for innovative materials on highway projects. The 100 year old rule was deemed outdated and it is opening up for state DOTs to cut through FHWA friction that often comes with trying new and innovative products.
The rescinding of the rule was a result of an American Road and Transportation Builders Association petition to FHWA last year.
